Can a Portuguese Company Accept Cryptocurrency Payments?

Yes. A Portuguese company can generally agree to receive a cryptoasset as consideration for its own goods or services.

This guide focuses on a customer paying directly into a non-custodial wallet controlled by the merchant. The payment does not pass through a processor that takes custody, exchanges the asset or settles funds for the seller.

Cryptoassets are not legal tender, but Banco de Portugal notes that they may be used as a means of exchange for goods and services. The company must still issue the required invoice, value the transaction and comply with tax and accounting rules.

MiCA in Portugal

Portuguese Law 69/2025 implements national elements of MiCA and allocates responsibilities between Banco de Portugal and the CMVM. The legacy transition for qualifying virtual-asset businesses ran until 1 July 2026 or an earlier authorisation decision.

MiCA authorisation applies to the professional provision of defined cryptoasset services, including custody for clients, exchange, trading platforms, order services and transfers on behalf of clients.

Direct receipt into the merchant's own wallet for its own invoice is not one of the listed services. This is an inference from the defined activities and does not cover a company that acts as a payment intermediary for others.

Portuguese Tax and Accounting Treatment

The Portuguese Tax Authority has published a binding-information document addressing cryptoassets received as consideration for professional services. It treats the receipt as non-cash consideration that must be valued under the applicable income and VAT rules. That ruling concerns its particular facts, but it confirms the importance of a euro valuation when services are paid in crypto.

For companies, the original sale should be recognised under the ordinary corporate accounting and tax rules, while the cryptoasset received must be recorded and classified separately. Portugal's Accounting Standards Commission notes that a cryptocurrency that is not cash or another financial instrument will generally be a non-monetary asset.

VAT and Portuguese Invoice Requirements

The method of payment does not remove VAT from an otherwise taxable supply. The company must determine the normal VAT treatment and preserve the euro taxable value.

The Portuguese Tax Authority states that a business or professional activity generally requires an invoice for every supply of goods or services. Invoices are normally issued by the fifth business day after the supply, or on the advance-payment date if payment comes first. A receipt documents payment and is associated with the invoice.

EU Travel Rule and the Company Wallet

Where a CASP participates in the transfer, EU Regulation 2023/1113 requires originator and beneficiary information. For a transfer above EUR 1,000 between a CASP and its client's self-hosted address, the CASP must verify ownership or control of the address.

The company should be prepared to demonstrate that the legal entity controls the receiving wallet. This is not a EUR 1,000 cap on direct payments.

Can a Portuguese company accept Bitcoin for services?

Yes, subject to normal commercial, tax, accounting and compliance requirements.

Does direct acceptance require a MiCA licence?

Not generally where the company merely receives consideration for its own supply. Custody, exchange and transfer services for clients require separate analysis.

Is crypto legal tender in Portugal?

No. Banco de Portugal does not treat cryptoassets as true currency or legal tender, although parties may use them as a means of exchange.

Does the company still need a Portuguese invoice and receipt?

Yes. The blockchain transfer does not replace the required commercial and tax documents.
